NO MORE CRIMINALIZATION OF TRIPLE TALAQ
After three failed attempt government has successfully passed the Muslim women protection bill, 2019. To stop criminalizing the instant triple talaq. The supreme court said that “if a husband uses triple talaq will be sent to jail for three years as a civil offence”.
The government successfully passed a bill against triple talaq, which failed three attempts in the last 19 months. After the bill is passed, Modi tweeted that “India has corrected historical wrong done to Muslim women”. The supreme court effectively said that even after pronouncing triple talaq three times the wife and husband will still have no difference in the relationship.
According to article 14 instant triple talaq was held to be violating the right to equality. They also added in section 498A that women have to right to complaint on husband or relatives for cruelty. Untouchability is abolished but still, it is in practice. Now women have a right to fight against physical pressure and mental torture.
This bill is passed by the law minister, Ravi Shankar Prasad, cited jail provisions in legislation to ban dowry and Muslim three terms practices. This matters a lot for women empowerment, gender equality and humanity. This has made to stop the unwanted separation between couples, against wife’s wish.
According to the bill, the Muslim men can take divorce by waiting for three months and get divorced through the court of law. If they dissolve the issue in some days it will be good but men should not take triple talaq route to leave the woman.
